I have received a additional invoice of service tax from labour supply contractor. He crossed a 10 Lac limit on the month of July 2011. But his registration in process and he submitted a additional invoice for service tax amount on above 10 Lac in the month of Dec 2011 for the period April 2011 to Sept 2011. As per the cenvat credit rule 2004 cenvat credit allowed or disallowed on additional invoice of service tax amount?

Cenvat Credit allowed on additional invoice.... but labour contractot is not suppose to charge additional service tax invoice.. becoz although limit of 10lac cross in this year after sep but since contractor is ssp last year...... service tax shud not be charged on first 10lacs billing of current year...!!!
