Cenvat on imported coal

Sir,

we r sponge iron manufacturer, and we imported coal from Australia. My question is how can i take the cenvat credit and what to take (Import duty, CVD, CESS). pl explain.

Dear Hunnruappa,

On import BCD, CVD and SAD will be levied .

I doubt levying of Cesses "Please see the Bill of Entry"

CVD and SAD can be taken as credit. However the same needs to be availed only when you are charging excise duty or exporting your final goods.

Thanks for your reply, and in Bill of Entry customs levied Cess on CVD and SAD is not applicable to the product, can we take credit cess also? pl give reply.

That is not CVD cess so not eligible to avail .

It is a customs cess, so not eligible
