Cenvat Credit of Service Tax after Show Cause Notice

Dear Sir(s),

Whether benifit (Cenvat Credit) of service tax can be availed after issue of Show Cause Notice.

It was a cese where our company is paying service tax after we received Show Cause Notice and we want to avail the Cenvat Credit on service tax.

Hoping a favourable response in this regard from all of you .

except GTA service (outward) u can take credit, GTA outward services are not eligible for cenvat credit, as those are not input services .

You are providing service and failed to pay service tax. Now you are under show cause notice that service tax to be paid. there are some input service used for providing the service . Doubt is about cenvat credit eligibilty. Yes, if you opt to pay tax , you can claim cenvat credit in respect of the input sevices.

Please mention the Activity of your company first. Whether it is a Menufacturare or Service Provider & the kind of Service Tax that you have paid after Show Cause Notice is it for Outward Service or Input Service?
