Cenvat credit in works contract
please guide me....as if main contractor has paid s.tax at 4.944%(after abatement) and also sub contractor for the same work has paid s.tax at same rate than the main contrActor can take benefit of cenvat credit of s.tax paid by sub contractor ??

For the execution of same contract two persons are not required to pay Service Tax again and again.so,you can not avail credit of S.T paid by the sub contractor.
Yaa if sub contractor raise the bill in the name of main contractor then cenvat credit can be taken by main contractor
yes sub contractor has raised the bilk in the name of main contractor. but s.tax department is in stand that if abatement is claimed by main cotractor than no cenvat credit is available
Bro in case of works contract only cenvat credit (ccr) of excise duty on inputs is not allowed but ccr of service tax on input services is allowed
