Cenvat credit

Hi

I am a dealer, I am registered under central  excise. can i bill to the end customer excige duty and can i claim the cenvat credit,

 

Fo exmample.

Manufacturer bill to me

100+ excise duty + Vat

Dealer 

110+ Excise on 110 + Vat

Can it Be possible?

Please help

Dealer can never claim Cenvat credit....they can only pass the cenvat cr of excise charged to them(by manufacturers) provided such dealers are registered as 1st/2nd stage dealer with CE deptt..

Yes its right. Unless or until the dealer has got registered with Excise Dept, he cant charge ED in his bill. And he cant claim the cenvat but can pass on the same to the purchaser.

If you wish to bill to the end customer then accordingly no cenvat cr, can be admissible.

FSD or SSD is only applicable in cases you are trading goods to manufaturing units whether directly or indirectly.
