If an audit firm which is appointed as a statutory auditor of a company merges with the other firm whether such a case is covered under 'casual vacancy' of the auditor? should the company reappoint the new (merged) firm as the auditors in place of the previous one?

Dear Gauri,

I feel, yes the Board Should appoint the merged firm as Auditor's subsequent to the merger till the next AGM

Dear Frnd,

In my opinion this is not a a case of CASUAL VACANCY .

statutory auditor is not vacating his post inthis case so this is not a case of casual vacany

Dear Friends, I tell u why I am saying this, because A Firm can be appointed as Auditor of a company in it's name and subsequent to the merger Firm with the new name has to be appointed...

absolutely rite....the company must hav to pass a board resolution if dey wnt 2 appoint dis merged firm as an auditor

when the firm gets merged with another firm, the old firm is dissolved. It is equivalent of death as mentioned in the Act.Hence it is Casual Vacancy. Therefore the BOD can appoint the new firm if wiiling. It is not necessary that only the newly merged firm should be appointed as Auditors.

When a two firm merges or new partner is joined to any firm  , the firm must disclose the fact and then after company has to decide that they have to appoint the auditor or not,but it doesn't create any casual vacancy.
