Sir/Madam A relative of mine has made a settlement deed in the year 2013 transferring two flats to his spouse and tne settlement deed is registered.Now in 2016 spouse want to dispose both the flats. Is she has to pay capital gains tax since the time lapsed between the settlement deed and sale is more than three yeats

Clarify more over settlement deed, as otherwise the gains may occur in the hands of husband also!

Settlement deed is done by her husband in the month of October 2013 and he expired on 2014

Legal aspect of the settlement deed is not clear. Is it sort of WILL?

Clarification about transfer of ownership of the flat in favour of your relative is required for any analysis.
