Capital gains holding period Trade dt OR settlement statement?

Quick Summary
This discussion clarifies the calculation of the holding period for capital gains tax on shares. The consensus, supported by CBDT Circular No. 704 dated 28-04-1995, states that the trade date is considered the date of transfer for determining whether gains are short-term or long-term. This is because the economic transaction and realisation of gain occur on the trade date, not the settlement date. The circular also addresses scenarios where securities are bought in multiple lots, recommending the FIFO method for calculating holding periods.

The broker report has a disclaimer that the contents have to be verified by the BO .At times the reports are in variance and one has to calculate oneself the capital gains and then this vital circular comes into play!Stop "chalta hai" attitude.Eat Sambhar in moderation so that you don't raise such questions. Please develop good habits!

You asked a question. Then ignored what everyone else said. Then pasted something you already had.

So what was the point of asking a question in the first place?

I didn't ignore what others said.I am just insisting that when a person answers it should be backed-up by relevant laws!
I had specifically asked for section or circular for the views!

Now, for substantiating my suggestion that excel should be ready txn by txn ,it is necessary as brokers reports are inaccurate from past experience and if items like dividend income and capital gains are on higher side client ends up paying taxes on higher side!
In today's time earning income has become a very tough job and entails uncalled for hardships. If this is not enough should law abiding citizens also end up paying inflated taxes because broker report is inaccurate and on the higher side? Also note for LTCG and STCG taxes start at 15 and 20% which is exorbitant!
Tax Report from brokerage houses will be taken care of compliance issues..
At what cost?Shell out higher taxes .Share market has too many taxes in various heads and income tax rates start at painfully exorbitant rates.Besides one has to shell out exorbitant charge for return filing.Every one wants "his shares of shylocks piece of heart" at the expense of innocent share market client! Making money in share market is extremely tough and too many people want their unjust cut!
Tax report can be downloaded at free of cost
Eat less Sambhar as you are failing to get the point. You will realise once you age and can't work and sources of income dwindle and you are left fending for your in the share market jungle with too many wolves on prowl.Once the bones soften every penny that goes out pinches the heart a bit too much.
Eat dosa . Feeling like your stomach is full to review others opinion..
Murugaa! Murugaa!
Thalaivaa ! Thalaivaa !! Thalaivee Thalaivee ..
Aiyaya! ayayeyooo! Lungi dance! Lungi dance!
Om Namah Shivaya
