Cancellation of return filed

Dear Members,

One of my clients had filed an ITR for F.Y 2012-13 and overlooked the fact that there was tax payable in the same. I am hereby attaching the copy of notice received from income tax department which is self expanatory.. Kindly go through the same & provide me solution to tackle with the issue.

You have to file rectification after login, where you have to mention your tax payment challan..

how can one file rectification for cancelled return. can you elaborate? as far as my knowledge goes, we can file rectification for intimations u/s 154.

In this case there is nothing you can do online except for paying the remaining tax dues.  Once the tax is paid.  Kindly approach the jurisdictional AO with an application for condonation of delay in filing the return (yes it will be considered as delayed filing as your earlier return doesn't exist anymore) along with proofs of tax payment, Form 16/16A etc.  Thats all you can do

Due date for filing income tax return for AY 13-14 relevant to FY 12-13 under section 139 was expired on 31st March 2015. Now it is not possible to file the return under section 139. You can file the return in response to notice under section 142(1), for that AO has to give notice 142(1). Approach the AO to give notice under section 142(1).

Return filed once and Verified, cannot be cancelled by the individual. Only a rectification is allowed if the return was not processed. Once a return was processed (even if it was error), you need a appropriate Ack No under the appropriate section from the CPC or AO. Without that Ack Number, you cannot revise your return even if the return was errorneous.
