Can we issue Form No 16/16A without PAN of the deductee

Dear All,

Can we issue Form No 16/16A without PAN details of the deductee for the financial year 2008-09, few deductee are not having PAN information.

If we issue the Form No 16/16A to the deductee without mentioning PAN details is it valid or not as per Income Tax Act/Rules

Please advice me as early as possible

if they dont have PAN, than there is no use of issuing the certificates as they cant file their ITR's and claim refund without PAN.

Now a days it has become mandatory. Without PAN no. U can't issue cert. in 16 or 16A and U can not file yr. TDS Return. Better ask the person to apply for PAN with require detail, within 7-10 days He/she will get PAN. U hav to see what is your obligation. U need not to worry hoe the deductee will file his ITR or will claim the refund without PAN
