The time linit for filing of the income tax return is one year from the end of te A.Y. i.e. 1 year from the A.Y. 2008-09 will be 31.03.2010. Hencethe due date for the return of A.Y. 2008-09 will be 31.03.2010.

Yes, He can file it upto 31.03.2010. The levy of penalty of Rs.5000/- is not your matter. It shall be payable only if Assessing offices imposes it. But filing can be done. No issue at all.

Yes he can file his ITR for the assessment year 2008-2009, after filing his ITR for the assessment year 2009-2010.

As far as penalty is concerned, It is levied only if Assessing offices imposes it, and that is also after expiry of one year from the end of relevant assessment year which is 31-03-2010 in your case.
