Can i get refund of excess income tax paid?

690 views 4 replies

I had efiles ITR-1 first on 31st July, 2012 and again on 31st August, 2012 since I made some corrections in the IT calculations and paid some more tax in august 2012. However, some excess amount of income tax was paid due to my mistake and also due to hurry I neglected income tax deduction due to house rent. The amounts are not huge though, about Rs700 excess paid due to neglecting house rent deductions and about Rs85 paid due to a strange issue: the excel sheet showed this amount to be paid as interest but that happened since default date set in my computer was wrong (shown to be september, 2012 while in reality it was august,2012). Can I claim refund of these excess amounts paid? or is it too late to claim? In case I can, please tell me the way to do it.

Another issue is that after efiling two returns earlier, I received two statements from IT dept at bangalore but the pdf files were corrupt and I was unable to open either of these two files. What should I do about this? (I had duly sent signed ITR-V two times and I am sure they had received these).

How u filed two returns

u filed 2nd return as revised return

firstclarify me this

ok

If u filed as revised return and u filed ur first return within due date then u can file another revised return

ok

That's true; the second return was revised return within due date (please note this year the due date was extended till 31st august, 2012 and I submitted on that very day.)

So I need to file another return (ITR-1; please mention under which section) after correcting that income tax amounts but what is the procedure to claim refund?

Also is there any last date before which such returns and refund claims are to be made? Thanks.

U submitted ur second return as revised return

and u got acknowledgements from CPC bangalore

If u does then file as a normal return now and claim refund and give the details of previous return in the return

As per mu understanding, you should file a revised income tax return as per section 139(5) and claim the refund (excess taxes paid). There is no separate process of claiming the refund, you should be mentioning the amount of income and taxes paid in the revised return. Also, you should go to the income tax website and check the CPC receipt status of the ITR-Vs. Also, you should view the demand status of the FY 2011/12 by logging in to the Income tax website and then My Accounts.
