Breach of non-disclosure agreement

Hi all,

 

What is the legal remedy in case a party breaches the Non-Disclosure Agreement.  In the agreement that I have, there is no monetary penalty mentioned except injunctive relief and that the aggrieved party can have the provisions enforced by court having equity jurisdiction.   

 

1. Does this mean that I can only have injunction enforced by a court?

2. There is no monetary penalty even if the IPR has been breached?

 

Please advise.

The full agreement related to NDA need to be srutinized so that proper suggestion on the same can be given otherwise it will harm you it shall be better if you see a local lawyer who can very well go through your agreement and then only suggest

Injunction imposed on the accused is also a way of putting the aggrieved person in a position to demand damages for breach of contract. So you may consult a IPR lawyer and not just any lawyer who may show you ways to not only impose injunction but also recover damages to be paid to the aggrieved.
