Ay 2009-10 income tax return

Hi friends,

One of my friend failed to file his refund return for AY 2009-10.

Is it possible to file this refund now.

I am asking this doubt because Assessment for AY 2009-10 is over by 2010 itself.

It is not possible for the Assessee to file the Income Tax Return for A.Y 2009-10 as it has become time barred.

You can voluntarily file an application to the Commissioner asking for permission for filing the return. He has the power to condone the delay and direct the assessing officer to accept the return and process the same. In any case this return will come under scrutiny.

Clarification

the powers of condonation of delay are exercisable by Commissioners of Income-tax if the claim is below Rs. 10,000, and by the Chief Commissioners of Income-tax if it is above Rs. 10,000 and up to Rs. 1,00,000. In respect of cases where amount involved is more than Rs. 1,00,000, the applications/requests are dealt with and decided by the Board in accordance with the powers vested in the Board.

It has also been decided that cases where delayed claims of refunds are being considered would be taken up for scrutiny.

since it was refund return for A.Y. 09-10, it should have been filed before due date. there is no such extended period applicable for refund cases.

The last  date of filling belated return for A.Y 2009-10  was March 31,2011.

So it is not possible to claim refund also

I agree with Deepak Gupta, still return can be filed if and only if condoned by the corresponding authority.

i have filed IT RETURNS for 2014-15 and 2015-16.but my i dint filed for years 2009-10 to 2013-14. Isn't chance to file income tax online or manual. what is the procedure for claim TDS.Please suggest me.
