If you had not completed the one year period of articleship then only the ICAI allows for transfer of articleship provided the transfer is done by mutual understanding by principal and article. If the principal refuses to give transfer, institute is helpless. Institute can allow transfer after one year on the following conditions:
1. If the principal dies.
2. If the principal / article is shfiting from one place to another which is around 50 kms away from its current place.
3. If the article is not able to go to principal's office due to any medical problem.
4. If the principal wants to join industry and quit practising.
5. If the name of principal is removed from the Register of Chartered Accountants under Chartered Acccountants Act.
Also if the principal is not paying proper stipend to the article as per the guidelines issued by ICAI, then the article can file a complaint against his/her principal and ask for transfer.
These are the some situations where you can get transfer.
