Please guide me on the following issue:
An Auditor has been appointed in AGM for 5 years (2019 to 2023). He has done the audit for March 2019 and signed the balance sheet. Now the Company (PVT LTD) in March 2020 has appointed another auditor, without prior informing the previous auditor and without asking for the resignation of the previous auditor. No ADT_3 has been filed till date.
The new auditor has signed March 2020 balance sheet without the filing of form ADT_1. The annual returns of the company have been submitted to the ROC.
The Company has mentioned the SRN of Form ADT_1 of the previous auditor and has filed the returns.
Please suggest what the previous auditor needs to do now? What are his liabilities? And what actions he can take.
