Hi,

This company XYZ Pvt. Ltd., wants to appoint Mr. A, an additional director, as its WTD. Also, Mr. A is the real brother of Mr B, a whole time director of the company. Whether in this case, Section 314 will apply?

As per my opinion, Directorship cannot be said to be an OPP, Please share your views. Very Urgent.

Dear Aksh*t,

The consent of the company is required to be obtained either in the general meeting or within three months from the date of the appointment, whichever is later.
