Am i eligible for 44ad or 44ada?

I am a website developer and I have an office and 3 people work for me ( I am the proprietor). My total receipts are below 50 lakh. Am I eligible for 44AD or 44ADA?

If proprietor technically qualified in same field...... Go for 44ADA....

Owning a business has nothing to do with your educational qualifications.

If your spedning money to make money i.e., you have operating costs, advetising costs, etc. you are a business.

A professonal is someone who just makes money by very little spending of money and for his time and skills only, whereas the business is where someone makes money by not just spenidng his time or skills, but a significant amount of money too.

Since you have 3 employees, an office and maybe have some other operating costs, you are a business and can opt for 44ad.

So if i have filed my ITR by showing myself as an individual, will that be treated wrong? 

You are technically qualified therefore you will come under the category of profession. You can file ITR- 4 (Apply Section - 44ADA) or ITR-3 its depend on you.

If you have sole proprietory business, Whatever ITR form (ITR-3 or ITR-4) will fill that will return of individual.

Well, I have just replied to your query recently posted on the same subject.

Actually, this year department has sent such notices to many such professionals......... 

The same codes were accepted till last year, but this year due to recent changes made in the nomenclature........ such notices have arose due to system glitch.

Just reply as said (u/s 44AD) without changing any other data....... It will get cleared....
