I own a flat promoted by Lancor. No owners association has been formed by them and as a result we have been charged servive tax twice for few expenses like diesil purchases, AMC on equipments etc. by their maintenance group.Is their any provision in the law where the service provider can adjust the service tax paid for AMC towards the service tax that he has to pay for the services he has provided. .

Kindly give some more clarification.
A maintenance company has entered into a contract with us for maintaining our apatment complex. We have been charged Rs3.40 per square feet which includes AMC for equipments (including service tax on that). Apart from paying service tax tfor AMC indirectly through the maintenance company we are also being charged service tax for the same additionally by the maintenance company because AMC is being taken by the service provider on behalf of us. We heard that the service tax that has been paid to the company providing AMC can be deducted from the service tax of the service provider .
