If a foreign citizen(USA citizen) buys property in India, is he required to file return in India even though his stay in India is less than 180 days in the year and he rarely visits India?

Firstly a foreign citizen cannot buy property in India unless he had been India and earned income from India.

Secondly, he would have to file returns if he has income in India and not because of the fact that he own a house or not.

I agree with you Mr. Vishwas It is fact that any foreigner can't buy property in India but he can buy property here. If he is working in India and he is a tax payable person in India.

As per FEMA a foreign citizen is NORMALLY not permitted to buy property in India. Even the local state laws usually don't allow the same.

Is the rule same for NRI / PIO. NRI and PIO is different from Foreign National.

NRI and PIO are allowed NORMALLY to purchase property in india whereas Foreign Citizen is not allowed NORMALLY to purchase property in india.
