We had a lot of cases where 44AA was applicable but we choose to file by option, 'profit without books of accounts'. Still, ITR is processed without asking for books.

Lack of processing tools........... which are slowly and steadily increasing every year........

But the thing is that in these cases, they sent notice because we didn't fill the balance sheet. Just filled the profit and loss a/c by adopting the profit without books of accounts. In the notice they expressly mentioned that 44AA is applicable in your case. But still we filed using the 'without books option' and they accepted our revision.

Once you have filled P&L account without BS.......... notice received.........

You corrected with adding BS to the form.......... system accepts it as per books of accounts. 

(Because without maintaining books of accounts these details cannot be filled......... is as per provisions.......... System doesn't know...... Indian Jugad...........)

Actually I am talking about the options 44 to 53 in ITR 3.

Which schedule..... 'P&L'?     If Yes, they are (and any other non-filled raw) is treated as NIL or NA .......

Yes. Sch. PL. But my question is they already know that 44AA is applied.

As said earlier........ the system accepts that the provision of tax in case of individual/huf is not mandatory.
