Hey Sarath, sorry to hear about your tough situation. Here’s what you need to know and what you can do about your articleship termination issue:

Your Rights as an Articleship Student

  1. Right to Terminate Articleship

    • As per the Institute of Chartered Accountants of India (ICAI) guidelines, you can terminate your articleship by giving 3 months’ notice to your principal.

    • If you cannot serve full notice due to urgent reasons (like family emergencies), ICAI may allow early termination on valid grounds.

  2. No Work Doesn’t Justify Retaining You

    • If you weren’t getting proper work/training, you can raise this as a valid reason for termination.

    • A firm cannot hold your termination certificate hostage or refuse to relieve you indefinitely.

  3. Termination Certificate

    • Your principal auditor must provide you with a termination certificate after you serve the notice period or get the approval from ICAI for early termination.

    • This certificate is essential to join another firm or for future ICAI procedures.

What You Can Do Now

  1. Inform the Principal in Writing

    • Write a formal email or letter stating your family emergency and your request for early termination.

    • Keep a copy for your records.

  2. Approach Your Regional ICAI Office

    • Visit or write to your local ICAI chapter or regional council explaining your situation.

    • They can mediate between you and your principal auditor.

    • ICAI supports students in such situations, especially for genuine family emergencies.

  3. File a Complaint (if necessary)

    • If your principal refuses to release your termination certificate or communicate reasonably, you can file a complaint with ICAI Disciplinary Committee.

    • This is a last resort but an option if the firm is being uncooperative.

  4. Seek Legal Help (if needed)

    • If things escalate, you may consult a lawyer familiar with labor/education laws to write a legal notice.

    • But generally, ICAI intervention should solve the issue.

Some Tips

  • Stay calm and professional in all communications.

  • Maintain all written communications as proof.

  • Explain your family emergency clearly; ICAI usually sympathizes with such cases.

  • Try to get an early termination permission letter from ICAI if your principal insists on full notice.

Subject: Request for Early Termination of Articleship Due to Family Emergency Dear [Principal’s Name], I hope you are doing well. Due to urgent family circumstances, I am unable to continue my articleship at the current firm and need to return to my hometown immediately. I kindly request you to consider my request for early termination and issue my termination certificate at the earliest to enable me to continue my training elsewhere. I am ready to cooperate and complete any pending formalities within my capacity. Thank you for understanding. Sincerely, Sarath Lucky [Registration Number]
