139(8A)

Return of Income was filed as refund. However after 143(1) it was processed as demand. The time limit for 139(4) is also expired. The assessee can choose 139(8A) in this case if he foregoes refund. Do you agree?

Quick Summary
If your Income Tax Return was initially filed for a refund but later processed as a demand, and the deadline for filing under section 139(4) has passed, you might consider filing under section 139(8A). This is only an option if you are willing to forgo any refund. However, it's important to note that filing under 139(8A) is generally not accepted if a refund is due. Rectification of the original return may be a more viable alternative.
