Why extra 6 months of Hell to PCC students?ICAI's real truth

When the Supreme Court reversed the decision of Delhi High Courtin Shivakant Jha vs Union of India(2002) 256ITR 536, it said that,”The Court observed that many developed countries tolerate or encourage “treaty shopping”, even if it is unintended, improper or unjustified, for other non-tax reasons, unless it leads to significant loss of tax revenue.  The Court cannot judge the legality of

“treaty shopping” merely because one section of thought considers it improper. The court

cannot characterize the act of incorporation under the Mauritian law as a sham or a

device actuated by improper motives. The Court held that the impugned circular was

issued under section 119 and hence valid.”

 

Friends , all of you might be thinking that why am I writing about the case. Just think for a minute; and realize that can’t we compare the logic of this judgement against th transfer ban imposed like a dictator by the judgement. What I saying is that just as some of the section of these members are feeling so; ICAI can’t ban transfer for “entire” student community. Dummy articleship is banned but I am sure that all CAs as well as CA representatives didn’t approve of this rule to curb individual freedom. The instance of rampant dummy articleship was used by Uttam Agarwal to establish himself as the “messiah for genuine students” and used it to fulfill personal credential and add some achievement to his tenure.(which I think is already blackened by all what has happened in the Diamond Jubilee)

 

 

 

Ved Jain introduced one day gap; Sunil Talati brought record salary for fresh CA in campus placement; and TN Manoharan tried to simplify CA education by introducing CPT to increase the participation of students from diverse backgrounds to enter into CA studies. Uttam Agarwal chose the easiest think ie to target the “disorganized” students community ; who despite being a working class; don’t have a union to support them. Uttam Agarwal tried to do some damage control by announcing that he has sent a proposal to the Central Govt to decrease the articleship period of PCC students by 6 months. He used that to hoodwink student who were baying for his blood and were pressurizing to revoke transfer ban. He just diverted their attention so that he can utilize his full time to defend why his CCM S Gopalkrishnan should not be punished like the MCA wants.

 

 

 

Now let’s analyse  what Mr Chopra, new prez. Is upto these days. The oppressed article community who were looking upon Chopra to redeem them ; are puzzled why there has been  no response by the President  so far. May be he is not considering students area as a way to immoratilse himself in ICAI history or he is not wanting to take the risk of “stirring the hornet’s nest.”One thing is for sure; if there’s will there’s a way. If the president wants; he can have the rules relaxed for students.CAs are trained to bend the rules for self benefit; Chopra can do that if he wants.

 

 

 

Like a CNBC programme said infront of Sunil Talati; that “Can a Broker be trusted to head SEBI?” implying that SEBI is an object of national importance and the broker if heads SEBI will certainly not make rules benefiting nation but harming his personal interests.Maybe that’s the case with our ICAI( and Chopra saab also:There’s no personal gain so Chopra is ignoring our pleas.)

 

 

Sources say that shortly after March 27 2009 announcement; some Region’s councils were up in arms over the issue to ban transfer. But UPA appeased  them or dealt with them is a mystery.

 

If our Indian Constitution has legalized the concept of divorce; which is to break a relation if not running smoothly (and is technically meant to be for 7 births); then this relation for 3.5 half years is nothing ; and transfer should be allowed.

seriously yaar...

y only we are suffering 6 months more it is hell ...

affecting our studies and precious time...

ya jose3 u r ri8. But first transfer ban to remove hone do. Uske baad ye ho sakta hai. And i think 1 week has been passed of appointing new president Mr. Chopra and no steps for removing transfer ban has been taken. We can't predict what's going on in ICAI. ???

hope for the best,atleast mr.chopra should introduce 1 transfer...
As final coaching are not good in local cities.we have to rush in metro cities for coaching..

am also agree all of you.but i will complete my 3.5 years traning 18 april 2010,but i shuold be amended for the students .polices makes by instutute for the benefit of the student.but student not for the polices

Very Good! Jose. Totally agrred on watever u have raised. Actually it's a spoilage of not just 6 months but also the money. In this extravagent a student only doing training for wat it meant to learn the practical issues. But 3 years r sufficient. Let have a glimpse of loses which we might earn in last extravagent six months : 1) If we join some company as an average we r losing 50k x 6 months. 2) if a CA join some job he may be delegated with more reposibility & work which may decorate the CV more than as he works in CA firm as an apprentice.

m agree with the jose...why extra 6 months for PCC studnt, mr uttam prakash agarwal the retired presidnt of ICAI ..i think he Change the entire  training period of a CA studnt...

yes  i agree wit u josh ..y they tourching us by keeping 6 months extra traning compare to ipcc,          while reality is tht v facing more troubles thn a ipcc student in likw go in to metro cities , extension for leave taken etc....problems v facing.................................plzzzzzzzzzzzzzzzzzzzzzzz my request to institiute change this rule nd start new rulw by giving att of nov.2010 to           students who hv may2011 final due..........

The Institute should consider the demand of the students which seems genuine one.

Amarjit Chopra should remove transfer ban and restrict it to 2 in one city; and 3 overall; time between 2 transfer must be 6 months; and it should not be 6 months b4 any icai exam;

he should also reduce pcc stream's articleshi period by 6 months.

We should email him as well as bosnoida.

I think ICAI is having council meeting in march. I would rather prefer he decrease pcc articleship; and stall implementation of e-diary.

Being a proud student of Chartered Accountancy I would like to put my thoughts regarding the betterment of our profession, As we all want that Indian Chartered Accountants should be known as best professionals and financial advisor in the world.
I am against the new rule imposed by our Institute regarding the transfer of articleship within the city.
Reason behind is that as it is known to all that when a student passed CPT he don’t have any knowledge regarding the corporate world and therefore a good firm will not allow such student to work with them, this students have to work with a firm where scope of learning is very narrow, after completing the PCC and gaining theoretical knowledge we students should be allowed to work with a firm where scope of learning is wide otherwise we will not be able to compete with other professionals, as this term of articleship is very important this can groom student into a good Chartered Accountant and this period can’t be wasted in a firm where unrelated jobs of  audit are being offered to a students.
It is known fact that such decision is taken by our president to upgrade the professionalism between students but this is hampering the reputation of our profession.
One more thing I would like to request is that in our institute should come forward with a grievance cell for students and this grievances shall be solved as early as possible.
Being a student and interacting with large numbers of other student it has came in my knowledge that most of the students are leaving this course because their principals are mentally harassing them and institute is not taking steps to stop such malpractices.

We student have to post regularly our comment to president to reduce 6 months of articleship.
