Which ITR to use

Dear Sirs, 

I have a question on which ITR to be filled ? . I have income from following 

  • ✅ Handwriting classes - I take class at home for a student and also goto a external class to teach which is owned by someone else. 
  • ✅ Savings bank interest
  • ✅ Fixed deposit interest
  • ✅ NCD interest
  • ✅ LTCG from listed equity/equity mutual funds
  • ✅ STCG from listed equity/equity mutual fund

I'd examine further is the applicability of Section 44AD to my tuition activity. Overall amount from the handwriting class is less than 1 Lakh ruppes with 80% coming as bank/UPI deposit and 20% coming as cash per year. 

I have used following to show 1L rupees income

  • Section: 44AD (Presumptive Business Income)
  • Business Name: Handwriting Class
  • Business Code: 21008 – Other services n.e.c.

which allows me to calculate presumptive income as 

  • Digital receipts: @ 6% 
  • Cash receipts: @ 8% 

Question I have is Business Code: 21008 – Other services n.e.c.  correct selection for Handwriting tuition classes ? or I have to select some other category as I couldn't find any other suitable category for this type of income in the dropdown. 

Or you suggest that I should I fill only ITR 2 and show the income of 1L as other income source ?

Thanks for your response. I couldn't find any other Business Code. Can anyone from the knowledgeable CA's suggest which service Business code can be used. 

Also, I am not clear with statement "If the tuition income is shifted" ? . 

Does Tuition income qalifies for "Income from Other Sources" ?

ITR form depends entirely on the source and nature of your income. Quick guide for AY 2026-27:

ITR-1 (Sahaj): Salaried, one house property, interest income, agricultural income up to Rs. 5,000. Total income up to Rs. 50 lakh. NOT for directors, partnership partners, or anyone with capital gains.

ITR-2: Salaried or non-business income with capital gains (equity, MF, property), multiple house properties, foreign income/assets, or income above Rs. 50 lakh. Also if you are a director of a company.

ITR-3: Business or profession income with actual books. For F&O traders, freelancers with complex income, and partners in firms.

ITR-4 (Sugam): Presumptive income only under Section 44AD (business, 6-8% of turnover), 44ADA (professionals, 50% of receipts), or 44AE (transport). Income up to Rs. 50 lakh. NOT valid if you have capital gains, foreign income, or are a director.

NOTE for FY 2025-26: Non-audit business and professional taxpayers filing ITR-3 or ITR-4 have an August 31 deadline, not July 31. Only individuals filing ITR-1 or ITR-2 must file by July 31.
