"out of the two clinic, one clinic has not issued form 16," Suggests that you have been working with these clinics as Visiting Dentist. Check the section under which your TDS has been deducted, if u/s. 194J; go for ITR4.

have they deducted as contract or under salary?

thanks,

I have been working there as visiting dentists.is there anything wrong/penalty if I use ITR 1,as I have no other income to report

section wise details of TDS is available in Form 26AS

or you can find from your appointment letter where terms and conditions and your capacity are mentioned.

Dr. Mahendran, check with the TDS deduction form 16A, or 26As from Traces; if the TDS deducted is u/s. 194J, your income will be notified as Professional Income, and hence you will have to fill ITR 4. Though I have doubt, but if TDS deducted u/s.192, you may fill ITR1, subject to other compliences.

i agree with dhirajlal ji

thanks to all experts

Most Welcome
