Which itr to be filed?

Hi

My friend is a NRI and he has paid tax in the country where he is employed. Now he has come to india and will be settling down. he wants to file his return for AY 2013-14.

under which ITR should the tax return be filed? since he has already paid tax in the other country, we have to file it as a nil return only. Please clarify

he should file ITR-2.  if any income earned in India, should be included in this return or a nil return should be filed.

Hi.. we tried filing ITR 2. he actually worked in Japan. the rate of tax over there is 10% and there is a DTAA treaty between Japan and India and that rate is also 10%. however, when i convert the taxes he paid there and compare it with the tax applicable at the normal rates, then he has to pay additional amount of around 23K (the difference between tax amount as per normal applicable rates and tax already paid in Japan) 

Is there any way to file a nil return?
