Quick Summary
This discussion clarifies which Income Tax Return (ITR) form is appropriate for individuals earning a salary and also selling shares with a capital gain. The consensus is that if you have salary income and capital gains from selling shares, but no business income, you should file using ITR-2. ITR-3 is generally for those with business or profession income.

YOU CAN FILE ITR3
ITR-2

Since business income is not there one must use ITR-2

Salary + Capital Gain = ITR-2

ITR 2
