Whether Penalty Applicable Or Not in this case

Hello Sir,

I am Registered under GST as a Transporter from August 2017.
My Turnover is less (most of the service attract reverse charge i. e. samne vali party pay karti hai gst ) so I opted for quarterly option for filing GSTR - 1 & from beginning to now I have filed all the returns i.e. GSTR 3B & GSTR-1 ( in some returns with late fees ).

But not filed Annual return GSTR 9 because I read about that the exemption is given to the small taxpayers from filing of GSTR-9. So my query is that is there any non compliance of act if I continue to not file GSTR 9 ?

For F.Y 2017-18 and F.Y 2018-19, it's Optional for taxpayer to file GSTR 9 if turnover is less than 2 Crore. Yes, if you want to file than you can file it Voluntary as per your choice. (there is no non-compliance, if you file Voluntarily)

For F.Y 2017-18, now you can not file as due date is already passed..For F.Y 2018-19 you can ...
