1. Whether a pvt. ltd. Company can accept unsecured loan from any HUF in which director of the Company is a member or Karta ?
2. Whether a pvt. ltd. Company can accept unsecured loan from any HUF in which relative of the director of the Company is a member or Karta?
Plz advise based on Companies Act 2013 with relevant provision/ rule/ section.
company may accept unsecured loan from any HUF subject to the Compliance of Deposit rules as well as Section 180(1) (c) if celings limits exceeds.
if HUF is also a member of the Company then you can refer to exemption given to private companies where a pvt. co. may accept monies not exceeding 100% of the paidup share capital and free reserve from its members.()
