There is a delay in filing of the VAT return for the six month ended on 31.03.2010. The challan for the same period is paid within the time. However the Sales tax inspector has demanded a penalty of Rs 5000/-. Can he do so? whether it is in his authority?What are the provisions for the same? Is there any provision get away with the penalty?

Sales tax inspectors are not competent authority to pass any orders. Only above the rank of inspectors can pass orders. However you may send a written explanation, the delay due to beyond the circumtances.
