VAT ON Freight

Dear Freinds

I am confused whether VAT is applicable/chargable or not on Freight if charged seperately on the Tax Invoice. My legal consultant are of opinion that any amount received on account of sale is chargable to VAT as per definition of sale. My customer which is Govt Body is of opinion that VAT will not be applicable on Freight Charged seperaetly. Please help me with relevant ruling
