In the case of M/s. Tata Chemicals Ltd. V/s Collector of Central Excise it was held by Supreme Court that Cost of Returnable Packing Material need not to be included in assessable value.

some theories say that it is to be included on a proportionate basis...what is the ultimate conclusion?

packing material included but material which are returnable should not be included...
i am not aware of proportionate addition...so my opinion will be
packing material - included
if returnable - not included..

cost of durable and returnable is not included as it is amortized and included in cost of product itself
