Hi,

I am a French citizen, living in US since 2015 (tconsidered as a US tax resident).

I am currently sent to India by my company for a 12 months period (renewable).

My question is whether I should be considered as an Indian tax resident for tax purposes or not.

More specificly my question is : I am about to be âid salaries from US and maybe dividends from a French company I still got in France. I have read on the website of a famous french tax lawyer that I would still be taxable on these dividends in France. I would not like to pay double taxes (France and India) on these dividends (quite a significant amout).

Will I be taxable in india on those dividends? The payment would be on my Indian bank account.

for how long have you being in india
there is a DTTA between india and France which provides for exemption and reduced tax rates
article 11 of the treaty deals with dividends

I ve been here for 6 months now, and will be staying for an additional 6 months period.

So that I am now sure of the tax treatment (French rules and Indian rules seem to say the same, this probably comes from the DTTA you mentionned).
