Urgent!!!Procedure for filing form 23AAA

Our Company wants to file form 23AAA.What s the procedure for the same????

Kindly explain what kind of procedure you are looking for? According to me simply fill the form and upload.

 

 

The Central Government has power to exempt any class of companies from compliance with any of the requirements in Schedule VI if, in its opinion, it is necessary to grant the exemption in the public interest.

 

The Central Government may grant such exemption by notification in the Official Gazette and any such exemption may be granted either unconditionally or subject to such conditions as may be specified in the notification. [Section 211(3)]

 

Further, the Central Government may, on the application made by the company in the prescribed

e-Form 23AAA introduced by the MCA, by order, modify in relation to that company any of the requirements of the Companies Act as to the matters to be stated in the company's balance-sheet or profit and loss account for the purpose of adapting them to the circumstances of the company. [Section 211(4)]

 

 

 

I just wanted to know that once we have filed form 23AAA, so do we need to inform ROC also, if yes how do we do that????

Come on Priya!!! Do you think uploading of E-forms on MCA portal and intimation to ROC are two different things?

Process is as follows :

1. File form no. 23AAA on website of MCA and pay challan.

2. Thereafter also file complete set of documents including Form and copy of paid challan at MCA office at Shastri Bhawan. Till date physical submission is essential due to incomplete automation of MCA office.
