We are paying Pref. Dividend to parent company which is forign Co. we had already paid Dividend distribution tax ,Is it required to deduct TDS on this amount.

Section 195 states "Any person responsible for paying to a non-resident, not being a company, or to a foreign company, " does that mean we need not required to deduct TDS on this amount .pls help its urgent

HI Gargi,

When we pay DDT u/s 115O we need not deduct TDS on such amount paid as dividend provided the dividend is as per sec 2(22)a to2(22)d. In your case it is preference dividend so eligible for DDT and not required to deduct TDS.

No, maam its not that way here the term "Not being company" is used for non resident who is not a company. Your company need to pay TDS on other amount remitted.
