i am a pcc student and i registered for my articles on 21 july 08( doing graduation as well) i want to convert to IPCC or if not that atleast i want to leave my firm and get a transffer as i am not able to manage time for my studies and most of the time m not given work to increase my efficiencies, my time is getting wasted. my pcc attempt is due for MAY 2010 i.if i register for IPCC by 31st may i ll get the same MAY2010 atempt.

But in my firm they do not give transffers that easily, they have even told some other articles to do what they can but they wont give transffer..so what are my options..if they say no for my transffer what should i do??do i have an edge over them becoause converting to IPCC is my choice and also its upto my choice whether i want to terminate my articleship or continue with the same..plzz guide me regarding how to get transffer and whom shall i contact in case of denial at ICAI.???

As per Chartered Accountants Acr, transfer is possible only by mutual consent, death of principal or opting forn industrial training (applicable only for last year articles).

So, if the mutual consent is not there, then the further course of action is not mentioned in the act.

There are people who believe that by giving 1 month notice or 2 month notice, or by writing a letter to ICAI problem is solved. If any one knows what has been mentioned in the act in a situation where mutual consent is not there, please mention the relvant text/para or regulation number stating the course of action. Anything without this information is not official and cannot be enforced.

From my personal experience, I must say that this a loophole. If mutual consent is not there then you have no choice, thats what Ive seen. The implication is that there is no option but to work with that principal, without interest, without motivation.

Krunal is right. N ya, please dont shift to IPCC just for the sake of it ie- thinking of your attempt only.. I presume that you are in First year BCom... If your BCom college timings are managed well by your CA Firm, it s a blessing in disguise. N at this stage, you cant expect any significant quality work. You can decide to sit back OR shift to IPCC. Regading this, if you shift to IPCC, you are not going to get any credit for articleship served before passing IPCC. Just give a letter in writing to your principal ( Boss ) that as per the new course of ICAI, you are changing the course and hence relieve you of articleship. Try explaining to him that you are not going to any other place but you want to pursue the new course as old course is getting phased out. Tell him you will apply in this firm only after IPCC...
