Quick Summary
This discussion addresses a situation where an individual surrendered a new PAN card (PAN 2) after realising they held two PANs. Despite surrendering the new one, they received an intimation regarding the old PAN (PAN 1) and a penalty of Rs 10,000 has been levied. The advice suggests applying to the Income Tax Department, explaining it was a genuine error and that the duplicate PAN was surrendered voluntarily without being used for financial transactions, to seek a waiver of the penalty.

You can wrote an application for the same to ITD
Defend that it was a genuine error. Levying penalty could cause undue hardship to the assessee. assesee is honest and voluntary surrendered duplicate pan. assessee did not use for any Financials transaction.

This can be the probable defense.
