I have to file an cross objection before tribunal and i have the following confusions which i will be obliged if someone could kindly clarify-
1. Can i file Form No. 36 A of cross objections separately to the Paper Book and compilation to be filed against the appeal?
2. As there is verification in form no.36A. Does it require a stamp duty for verification or not.
3. Can the appeal of the department be dismissed before the tribunal if it lacks any content or lacks question of law. (I have a judgment of the Hon’ able High Court of similar state in my favour to just the same question of law).
4. Can the tribunal go against the judgment of the Hon’ able High court of the similar state or not.
5. Is the power of attorney to be filed along with Form No. 36 A or can the cross objection be filed directly by the assessee.
6. How can one know the name of the Departmental Representative so that a copy of Paper Book and Compilation can be delivered to him?
7.Should one file all the related documents if one has a similar case decided in his favour and the CIT appeals has passed an order in your favour due that similar case law.
8.Should one inspect the papers filed by the department at the tribunal before preparing his own paper Book compilation and whats the method to pay such a fees.
