Transfer to another city

As per the guidelines of ICAI, No request of an articled assistant for termination (transfer) of articleship shall be considered unless his/her working parent(s) is/are transferred from the city/place where the articled assistant is receiving training to another city and a copy of transfer order / proof is submitted to the principal in proof thereof. On such termination the articled assistant concerned shall join articles training in and around the place of posting of his/her parent(s) and shall not re-register articles in the same city or within 50 Kms radius of the city where he/she has undergone articles prior to such termination.

Its all up to the choice of articles whether to go for transfer or not….. Hence if you wish to continue your studies at Pune only, then don’t take transfer of articleship , Be regular on your present articleship , if possible….

But if you are taking transfer of articleship on above ground, then you cant continue your studies at Pune.... because you articleship is now in jaipur

Hi, Institute usually wont allow such transfers. As per their regulations, Institute allows you to change the Principal if parents are moving to another city. But in your case you want to work in Pune, I dont think its possible. Institute allows you to work only in Jaipur. However, you can try your luck by specially writing an application and your interest to do in Pune to have good work exposure, because there may be a hope that institute may consider on a case to case basis. You can not take transfer from Bhopal to Pune.

As per institute guidelines, you can either work in Bhopal with the same CA or take transfer to Jaipur by giving proof of transfer of parents to Jaipur.

Further if you are in first year of article training then you can take transfer to Pune.

I want to know that what are the different grounds onwhich Transfer can be granted from one city to another city ?

Transfer/termination of articleship shall be permissible on the grounds as stated below: -

I. Transfer / Termination of articles is permitted without any restriction during the first year of articles.

II. During rest of the articleship period on satisfying any one or more of the conditions as stated below: -

1. Medical grounds requiring discontinuance of articles for a minimum period of three months (on production of a Medical Certificate issued by a Government Hospital).

2. Transfer of parent(s) to another city.

3. Misconduct involving moral turpitude.

4. Other justifiable circumstances / reasons: -

(ii) Grounds already permissible in the Chartered Accountants Regulations, 1988 (on submission of requisite proof of the act warranting transfer/termination of articleship): -

a. Industrial Training (Regulation 51)
b. Secondment of articles (Regulation 54)
c. Conversion from PCC to IPCC (for termination of articles only. Re-registration of articles to be allowed only after passing Group-I of IPCC)
d. Death of Principal [Regulation 57(1)(c)]
e. Ceasing of practice by the Principal [Regulation 57(1)(a)]
f. Removal of name of the Principal from the Register of Member due to any reason [Regulation 57(1)(b)]

(iii) Marriage basis (only if there is relocation to another city involving distance of 50 kms).

(iv) Irregular payment or non payment of stipend with reference to Regulation 67.

(v) Articled assistant desires to serve balance period of training outside India.

(vi) Shifting by the Principal to another city involving distance more than 50 kms.

Presently I am working in Bhopal. My parents are being transferred to Jaipur. But I want to continue my articleship at Pune. Now I want to know How can it be done?

I think this is a dilemma for you.... If this is first yr of your  articleship then you can take transfer to Pune....but if you have completed more than 1 yr of articleship, then it is not possible to take transfer to pune, since you are not complying with the eligibility of Transfer rule.....

then You have just 2 choices, either continue at Bhopal or at jaipur....
