CA –Article Training Queries

 

 

Q.1    How much Leave an Article trainee is entitled to against the period of service served as

          Meaning thereby what is the number of leaves which will not be considered as leave out of

          the actual days not worked by an article ?

Q.2   The leaves which an article is entitled to on account of period served as trainee , whether he

          is eligible for the payment of stipend for the leaves allowed?

Q3. What is the status of weekly offs i.e. Sundays & holidays, whether an article trainee is deemed to be on training during weekly holidays(Sundays & permitted holidays such as 2nd Oct, 26th Jan,15th aug,Diwali, Holi etc) ?

 

               Eg: In a month of Jan 2010

Total Days in a month = 31

Sundays                       =05

Holiday(26th Jan)          =01

Articled Remained

On leave                       =04

 

Now Pl. clarify whether his effective training days are

(i)                  31 days-4leaves=27 days, or

(ii)                31 days-4leaves-6holidays=21 days

Q 4   What is the  min. hours of training which an article must undergo, if these min. hours are 35 hours in a week, whether an article is allowed credit of hrs devoted in excess of his min hrs of working in a week?

              

               Eg: An article’s working timing are Mon-Sat (11am-6pm) (1/2 hr lunch[1.30-2pm], then

                      He has worked (6 days X 7hrs=42hrs)-(1/2 lunch hrs X 6=3hrs) =39 hrs in aweek.

                       Min. hrs required =35 hrs in a week. Hours in excess of min= 4hrs.

 

Whether the article who has worked 4 hrs per week (4 X4 =16hrs /month) in excess of which requirement in a month is 35 hrs, is entitled to credit in exempting his leaves , in following manner- 16/6.5 hrs =2.5 days (approx) or Say 3 days in a month ?

Pl. answer my this simple query

my training started on 14.08.08

total no. of days b/w(14.08.08-17.02.10)= 553 days....(4)

no of sundays & allowed holidays(like holi,diwali,etc) =90....(1)

Total Leaves taken by me = 183....(2)

Total days I worked (effective)=280...(3)

1+2+3= 553...(4)

Now, as far I have understood, ICAI permits 1/6th eligible leaves of effective period, i.e 1/6 of 280=47

So, Leaves Permitted=47 , taken=180 , which means excess leaves = 180-47=133

I want to clarify following:

1. To calculate my completed months training , I Shall use following formula =

Effective Days worked+eligible leaves+sundays & allowed holdiays-sundays & allowed holidays (falling when I was on official leave)

=(280+47+90-4)/30 =14 months.

Pl. confirm I am right doing above.

2. Secondly, Shall I be paid for eligible 47 leaves i.e nearly 1.5 months ? if yes, at what rate?

3. Thirdly, mine a six day office , I work for 6.5 hrs daily i.e 39 hrs , as per ICAI requirement 35 is min and i work 4 hrs excess evry week, but there are many days when I remain absent for aday or so in a week & in that case my min working hrs of 35 hrs are not fullfiledd so,will my excess 4hrs working will nullify those leave ?

4. Again Shall I be paid for excess hours worked?

5. Last, Do sundays n allowed holidays form part of training? And, what if I am official 2 month leave and during that period 8 sundays fall, so whether they will form part as my training or not?

Pl. on urgent  basis have my above queries cleared as I have to fill my PCC exam form?

its a very big question whther the sundays and public holidays falling within the leave days will be considered as leave or an exception to the no.of days of leave avalied. plzzzz help.
