Termination queries.

I am considering taking a termination of articles as I wish to leave the CA course on account of personal reasons. I have already served 2 and a half years of articleship and have passed my PCC exams in May 2010. However, I am still interested in pursuing the course in the future. Is it possible that after taking taking termination of articles, I may again re-register for the course? Will I get credit for the time served? Also, what is the minimum time I must stay un-registered? Which forms must I fill?

Yes you can take the the termination and the credit for the period served will be with you for the term of six months.For taking the termination just fill up Form No. 111. 

That means I have to re-register within a period of six months? Also, Form 111 is for Termination of Articled Service by a surviving partner. Why do I have to fill that form?

As per CA Regulations, Regulation 57 Fresh Articles

(1) Where an articled assistant is not able to complete

the term of the articles by reason of the fact that (a) the

principal has ceased to practise; or (b) the name of the principal

has been removed from the Register; or (c) the principal has

died; or (d) the articles are terminated under sub-regulation (1)

of Regulation 56, he may enter into fresh articles for the

remainder term of his service with another member entitled to

engage and train one or more articled assistants:

The period already served is recognised from the interpretation I could infer from the CA Regulations. However, confirm this with e-sahayata.

 

For termination of articles form 109 with the present Principal has to be filled, for re-registration, form 102 and 103 with the new Principal.

i'm undergoing termination too. what the insti ask are:

1. form 109

2. form 120.

3. a self declaration letter

4. principal's consent letter

5. proof of reason for termination

you get credit for the period served. no time limit to stay without re-registering. its only the 'distance of 50 kms within which u shouldnt re-register' that matters. for any other clarifications, u may ask me.
