I have sent PCC to IPCC conversion form along with Termination form (109) .

But ICAI has not accepted My termination. ( But they accepted my conversion )

They sent me a letter which is as follows:

Dear Student,

Sub:- Termination/transfer of articles

this has reference to form no 109/103 on above subject.

On scrutiny of the same we found the following:-

Since above papers received are not in conformity with the guidelines vide important announcement dt. 27.03.2009 & 30.06.2009 (Transfer/termination of Articles ) for detail you may access our website www.icai.ord(students link). You are therefore requested to revert back to your previous employer immediately. As per our record , you are still continuing your articleship under your previous employer

Inconvenience caused is regretted.

BUT I WANT IPCC ALONG WITH TERMINATION , THEN WHY ICAI HAS NOT ACCEPTED IT?

ACC. TO NEW RULES CA INSTITUTE WILL PROVIDE TERMINATION ON THE MATTERS ONLY LIKE SHIFTING FROM ONE CITY TO ANOTHER ON TRANSFER OF JOB OF PARENTS, ILLNESS, MISBEHAVIOUR OR ANY OTHER MATTER WHICH THE COUNCIL FOUND APPROPRIATE FOR TEMINATION. OTHERWISE INSTITUTE WILL NOT PROVIDE TRANSFER/ TERMINATION.

Dear Priyanka,

I went through the Inst Notification through the link provided by you it has a clasue which says u can go for termination in case of :

Conversion from PCC to IPCC (for termination of articles only. Re-registration of articles to be allowed only after passing Group-I of IPCC

I Think u also fall under this claus i will advise you to personally visit the Institute with the letter u recieived from the Inst,Copy of the notification Transfer/Termination of Articleship - (01-07-2009) and also a No objection crtificate if u can get from ur principal stating that ur principal has no objection in giving you a termination on mutual grounds complying with the regulations of the Institute.

Get an No Objection certificate from ur principal if possible before u gt Form 109 signed from ur principal and contact the Institute for reasons of rejection of ur application.
