TENANT IS NOT VACATING
My father has let out a commercial property to wholesale fruit merchant, since he was defaulted in paying rent, after completion of tenor we filed a case and got eviction order almost after 6 years. Tenant is a Muslim guy, somehow he managed police by bribing. Instead of acting on court orders, police took more time for accommodating tenant to approach higher court. By making allegations against judge, he approached higher court. Now there’s no judge in the said court. Officiating judge is simply giving fresh date. Almost after 15 months no progress in the case.. In between my father also passed way.. I don’t know how to go about it. Advocates expressed inability. Kindly suggest me for speedy disposal of the case.

As your matter is in higher court, you have to wait till its judgement.
Meanwhile, you have to add yourself or any other legal representative to represent on behalf of your late father.
If the tenant has not obtained stay over the lower court judgement (not specified here), you can proceed for evacuation proceeding..
You can ask your advocate to agitate case before the high court.
