Dear all,
I am working with a compay whom pays a heavy amount to CONCOR India on account of freight services. on which we did not deducted any TDS as this was paid as Railway Freight.
Pls Suggest whether we are wrong ??
N also guide me what the step to be taken right now.

Dear Nitin,
In my opinion you are not wrong.
Sec 194C deals with work contracts including carriage of goods and passengers by any mode other than railways.
Mr. Nitin Jain you are correct.
As CONCOR India (Container Corporation of India Ltd) is a govt undertaking you do not need to deduct TDS.

But how could we relate this payment with the railway freight as concor india does not provide any details regarding this?
Concor India is established under companies Act and it is not a govt Authority or corporation so TDS deduction as per law TDS should be Deducted.
Please also refer any provision of the act related to the matter.

Tds should be deducted on container corporation of india ltd. on its agency charges not on its freight charges.
container corporation of india is not fully govt enterprises but C.govt holding 63% of it.
