A Govt. aided school didn't file its TDS Return for the FY 2010-11 and FY 2011-12 but the tax deducted on the teachers' salaries had been deposited in the credit of the govt.

Now, is it possible to file TDS Return for those FY?

If yes, then what is the amount of penalty or late fee or like that?

Yes you can file the TDS FY 2010-11 and FY 2011-12. The late filing is at the rate of Rs 200/- per day or total amount of TDS in that quarter whichever is lower. Just prepare the TDs return and submit it to TIN-FC without paying the late fee if its accepted then no need to pay late filing fee. If the type of deductor is government then it will surely accept without late. You can also contact me at admin @ schooltds. com

Thanks for your valuable reply. One more thing that I want know that is whether I need to file TDS Return for each quarter of 2010-11 and 2011-12 or just Q4 of 2010-11 & 2011-12 which would include all the deductions made during the 4 quarters?

If the deduction is done in all quarters then you have to file for all quarters. if the deduction is done only in the last quarter for the whole year then you can file the last quarter alone. Moreover late fee can be levied only for returns from 01.06.2015 onwards.

Okay, Thank you so much for the guidance.

Moreover late fee can be levied only for returns from 01.06.2015 onwards. is there any provision or case law in this regard available with u? if yes, kindly share the same.
