Tds on stipend ???

need help ... Can TDS be deducted on stipend ???
The amount of stipend is 4000 and 10 % TDS is deducted 3600 is received by the articled assistant
The employer has deducted TDS without having any details like PAN No
What To do now ??????
what are the limits for deducting TDS ??

In your case no TDS on stipend is applicable.

Every Employer who is paying salary to his employee which is more then maximum amount exempt from tax has to deduct TDS on such Salaries Under section 192 of the Income tax Act,1961. Hence, in your case no liability to TDS. You can ask for explanation for the same to your employer.
1. stipend is not covered under salary definition in the Act. 2. stipend is exempt under sec 10(16) of the Act. 3. TDS provisions under sec 192 are also not applicable because here there is no employer and employee relationship exist. 4. Here there is principal and student relationship exist. Conclusion: Your principal cannot deduct Tax at source. Its wrong.
