Tds on salary

In our company, we use own delivery vehicles for delivering goods to our own branches spread accros maharashtra. We used to pay some amount on per ton basis to the drivers towards unloading expenses. We did not obtain any proof of actual expenses by the drivers.

Now my query is will this amount will be considered as salary as per terms of income tax act?

I think there is no Employer-Employee relationship. it doesen't come under salary

In my opinion it should be considered as work contact on temporary basis, since no employer-employee relation subsist it should not be considered as salary. it should be shown under work contact expenses or sub head loading & loading charges under the head selling and  distributions expenses..........wait till other say..

 

Hello , I think in practical scenario amount which u paid to ur driver is very less .. upto  Rs-250000 there is no taxation.
If you think practically then this type of question will not arise. 

These services may be considered as contract and you may deduct the TDS as per sec 194c.

It will be treated as unloading exp. and i think it will pay to different persons "who unloading the vehicle "by the driver and  after that same amt  reimbursed by you to driver.

So u not need to consider this amt in driver salary
