other party is also charging service tax on it's bill.

yes TDS should be deducted on reoair & maintenance if payment exceed from limit.
Tds on repair and maintence come under the category on tds on contract hence Tds will be deducted under section 194c . total amount includes service tax also because TDS on contract deduct on any sum paid .
