TDS on Rent

Hi,

The Let Out Property is in the name of Husband.Rental agreements are prepared seperately in the name of Husband and Wife.Half Portion of the rent is paid to the husband and the other half is paid to his wife. on consolidating both of the rental amounts it is exceeding normal limit of TDS, but if we consider separtely it is not exceeding the limit

Now tell whether we shld deduct tds on their payments r not?

Dear Sathish,

This is one way to defeat the provision of TDS & it is indeed happening practically in many cases.....

TDS will not be deducted since individual payments has not exceeded the threshold limits.

The fact that the House is in the name of Husband only will affect the computation of Income, I mean clubbing & all that but have no impact on TDS provisions.............
